Man injured in construction accident, sues for millions

A serious accident on an out-of-state construction site has led to a landmark $55 million lawsuit, according to business news. Iowa residents may be interested to know the construction accident that precipitated the lawsuit involved a subway project roughly a month ago. The worker who was injured is reportedly suing the local transportation authority as well as the city in which the accident took place.

Accident reports have indicated the man was working approximately 100 feet below ground, pouring concrete through a large flexible hose. It apparently became unhinged and went "out of control." The hose apparently struck the man with sufficient force to injure his leg badly. The man lost consciousness and had to be lifted out of the hole when rescue workers arrived.

Since then, the man's representation has been in talks with the local branch of OSHA to determine whether attaching a flex hose to a concrete dispenser constitutes a safety violation.  So far, OSHA appears to have agreed with that estimation.  The man is pursuing a personal injury case against the city and the transportation authority, seeking $55 million in damages.

Whether the city and/or New York's Metropolitan Transit Authority are eventually required to pay out for the injuries suffered by the man in the construction accident, other options may be available to him to support him through this difficult time. Iowa residents may already be aware that workers' compensation packages exist to help pay for medical bills and lost wages during recovery periods. It is likely this man is entitled to such packages, though compensation laws typically bar a worker from suing an employer concerning an on-the-job accident. Negligent third parties, however, are not protected by the same statutes and can be pursued in civil court, based upon evidence of negligence.
